Companies doing business in Virginia must comply by either processing data of 100,000 consumers or more or obtaining over 50% of their revenue from selling data. Unlike the <a href=\"https:\/\/usercentrics-poc.psapp.devknowledge-hub\/california-consumer-privacy-act\/\">California Consumer Privacy Rights Act<\/a> (CCPA), the VCDPA does not allow private action by consumers and lacks a revenue threshold for businesses.<\/p>\n<p>Compliance involves adhering to strict data minimization, and security practices, and providing clear privacy notices. Understanding these requirements is crucial for marketing operations, achieving revenue goals, and building user trust, highlighting the importance of tailored compliance strategies for different data privacy laws.<\/p>\n\n\n<h2 class=\"wp-block-heading\">Compliant data is a critical business resource<\/h2>\n<p>These steps will help you achieve compliance with the Virginia Consumer Data Protection Act (VCDPA), which applies to and protects residents of Virginia. The checklist also includes recommended best practices for data privacy-related user experience.<\/p>\n<h3>Step 1: Determine if your company is required to comply<\/h3>\n<p>If your for-profit organization:<\/p>\n<ul>\n<li>processes the personal data from at least 100,000 Virginia consumers, or<\/li>\n<li>processes the personal data from at least 25,000 Virginia consumers, and<\/li>\n<li>derives at least 50% of annual revenue from selling personal data.<\/li>\n<\/ul>\n\n\n<div class=\"wp-block-cover is-light has-custom-content-position is-position-top-left\" style=\"margin-top:var(--wp--preset--spacing--l);margin-bottom:var(--wp--preset--spacing--m);padding-top:var(--wp--preset--spacing--m);padding-right:var(--wp--preset--spacing--s);padding-bottom:var(--wp--preset--spacing--m);padding-left:var(--wp--preset--spacing--s);min-height:50px;aspect-ratio:unset;\"><span aria-hidden=\"true\" class=\"wp-block-cover__background has-brand-white-background-color has-background-dim-100 has-background-dim\"><\/span><div class=\"wp-block-cover__inner-container is-layout-constrained wp-container-core-cover-is-layout-6c749cc1 wp-block-cover-is-layout-constrained\"><p><strong>Important to know:<\/strong><\/p>\n<p>The VCDPA came into effect January 1, 2023. It applies from that date forward and does not apply retroactively.<\/p>\n<\/div><\/div>\n\n\n<h3>Step 2: Create a comprehensive Privacy Policy<\/h3>\n<ul>\n<li><strong>Purpose<\/strong>: Inform consumers at or before the point of data collection:\n<ul>\n<li>categories of personal data processed<\/li>\n<li>purposes for which data is processed<\/li>\n<li>categories of personal data that the controller shares with third parties, if any<\/li>\n<li>categories of third parties the controller shares personal data with, if any<\/li>\n<\/ul>\n<\/li>\n<li><strong>Rights<\/strong>: Inform website visitors of their privacy rights and how to exercise them, including how a consumer may appeal a controller&#8217;s decision with regard to the consumer&#8217;s request.<\/li>\n<li><strong>Language<\/strong>: Ensure the <a href=\"https:\/\/usercentrics-poc.psapp.devknowledge-hub\/what-is-a-privacy-policy-and-why-do-you-need-one\/\">Privacy Policy<\/a> is clear and easy to understand.<\/li>\n<li><strong>Implementation<\/strong>: Make information about privacy and user options, like consent opt out, available via a <strong>banner or pop-up<\/strong> for when users visit your site, e.g. with a Consent Management Platform.<\/li>\n<\/ul>\n<h3>Step 3: Inform users about their rights<\/h3>\n<p>Consumers\u2019 rights under the VCDPA:<\/p>\n<ul>\n<li><strong>Right to Know<\/strong>\n<ul>\n<li>whether personal data is processed and receive confirmation and access to it<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Access<\/strong>\n<ul>\n<li>request and receive a copy of their personal data<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Correction<\/strong>\n<ul>\n<li>updates or corrections to inaccuracies in personal data collected<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Deletion<\/strong>\n<ul>\n<li>personal data that has been collected about them (with exceptions)<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Data Portability<\/strong>\n<ul>\n<li>copy of personal data must be provided in a portable and readily useable format<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Opt Out<\/strong>\n<ul>\n<li>of processing of personal data for the purposes of sale, targeted advertising, or profiling for decisions that would affect the consumer in a legal or similarly significant way<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Non-discrimination<\/strong>\n<ul>\n<li>for exercising privacy rights<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right of Minors<\/strong>\n<ul>\n<li>consent must be obtained from a parent\/guardian before children\u2019s (under age 13) personal data is collected<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Restrict Use of Sensitive Personal Information<\/strong>\n<ul>\n<li>limit or refuse the collection or use of personal data the law classifies as sensitive<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>Step 4: Inform users about their rights<\/h3>\n<ul>\n<li><strong>Review your operations<\/strong> and potential changes in the law every 12 months. Updating your Privacy Policy information and the effective date. Effective date should be updated even if you don&#8217;t make any other changes to the Policy.<\/li>\n<li><strong>Transparency<\/strong>: Ensure that the information that users must be notified about is clear, comprehensive and up to date.
